Liability Waiver, Release, and Assumption of Risk
Section 1: Purpose and Acknowledgment
This document is a legally binding agreement between the participant (and/or the parent or legal guardian of a minor participant) and Gnomeman's Land, Trad-Bow, Range and Course, Club ("the Club"), its owners, operators, employees, volunteers, agents, and affiliates (collectively, "Released Parties").
By signing this document, the participant acknowledges that they have read, understand, and voluntarily agree to all terms contained herein.
This waiver is a condition of participation in any and all activities at Gnomeman's Land, including but not limited to use of the archery range, field course, practice areas, and any club-sponsored events, competitions, workshops, or social gatherings.
Section 2: Description of Activities
Activities at Gnomeman's Land include but are not limited to: traditional archery shooting on a stationary range, walking and shooting a field archery course, equipment handling and maintenance, target retrieval, bow tuning and setup, and participation in club events, competitions, leagues, instructional sessions, and social gatherings.
The facility is located on natural terrain in Morrison, Colorado, which may include uneven ground, slopes, rocks, loose soil, vegetation, wildlife, water features, and variable weather conditions including but not limited to extreme heat, cold, high winds, rain, hail, snow, and lightning.
Section 3: Acknowledgment and Assumption of Risk
I understand that traditional archery and related activities involve inherent risks of serious injury, including but not limited to: being struck by an arrow or arrow fragments, bowstring injuries (including string slap and derailment), equipment failure or breakage (including limb fracture, arrow breakage, or broadhead injury), falls on uneven or slippery terrain, exposure to weather extremes (heat, cold, lightning, wind, hail), encounters with wildlife (including snakes, insects, spiders, ticks, and other animals), allergic reactions, cuts, bruises, lacerations, sprains, strains, fractures, concussions, eye injuries, hearing damage, and other bodily harm.
I understand that these risks may result in serious injury, permanent disability, disfigurement, or death.
I voluntarily assume all risks associated with my participation in activities at Gnomeman's Land, whether or not specifically identified herein, and whether arising from the ordinary or extraordinary negligence of the Released Parties or otherwise.
I acknowledge that I have been advised to carry personal health insurance and that the Club does not provide medical insurance or coverage for participants.
I certify that I am physically fit and have no medical condition that would prevent my safe participation in archery activities. If I have any medical conditions, allergies, or physical limitations, I have disclosed them in the space provided below.
I understand that conditions at the facility may change without notice due to weather, wildlife, maintenance, construction, or other factors, and that I am responsible for evaluating my own ability to safely participate at all times. I agree to discontinue participation if conditions become unsafe or if I feel physically or mentally unable to continue safely.
Section 4: Release and Waiver of Liability
In consideration of being permitted to participate in activities at Gnomeman's Land, I hereby release, waive, discharge, and covenant not to sue the Released Parties from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in activities at Gnomeman's Land, whether caused by the negligence of the Released Parties or otherwise.
I agree that this Release and Waiver of Liability shall be binding upon me, my heirs, executors, administrators, personal representatives, successors, and assigns.
I understand and agree that this release includes any claims based on the negligence, action, or inaction of the Released Parties, and covers bodily injury, personal injury, illness, death, emotional distress, or property damage, whether suffered during or after participation in activities.
I further agree that this waiver is intended to be as broad and inclusive as permitted by the laws of the State of Colorado, and that if any portion is held invalid, the remaining provisions shall continue in full legal force and effect.
Section 5: Indemnification and Hold Harmless
I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including reasonable attorney's fees and court costs, brought by any third party as a result of my actions or omissions, or the actions or omissions of anyone acting on my behalf, during my participation in activities at Gnomeman's Land.
This indemnification obligation shall survive the termination or expiration of this agreement and my participation in Club activities.
Section 6: Acknowledgment of Club Rules
I acknowledge that I have received, read, and understand the Club Rules and Regulations of Gnomeman's Land, Trad-Bow, Range and Course, Club.
I agree to abide by all rules and regulations, including all safety rules, range commands, course procedures, equipment requirements, and behavioral standards.
I understand that failure to comply with club rules may result in my immediate removal from the premises and/or permanent revocation of my membership without refund.
I understand that the Club reserves the right to modify rules, policies, and procedures at any time and that continued participation constitutes acceptance of any updated rules.
I agree to follow the instructions and directives of all Club staff, range safety officers, and designated volunteers at all times.
Section 7: Media and Photography Release
I grant Gnomeman's Land, its owners, operators, and agents, permission to use photographs, video recordings, audio recordings, or other media taken during my participation in Club activities for promotional, educational, marketing, or social media purposes without compensation, royalty, or further consent required.
I understand that I may opt out of this media release at any time by notifying Club management in writing. Such opt-out shall apply only to future use of media and shall not require removal of media already published prior to receipt of the written notice.
Section 8: Medical Authorization
In the event of an emergency, I authorize the Released Parties to secure emergency medical treatment, transportation, and care on my behalf if I am unable to do so myself. This authorization includes, but is not limited to, calling emergency medical services, administering basic first aid, and transporting me to a medical facility.
I understand that any and all medical expenses incurred as a result of emergency treatment, transportation, or hospitalization will be my sole financial responsibility.
I release the Released Parties from any and all liability arising from emergency medical decisions made on my behalf, including decisions regarding the type and extent of treatment, the choice of medical provider, or the mode of transportation.
Section 9: Colorado Law and Dispute Resolution
This agreement shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles.
Any dispute, claim, or controversy arising out of or related to this agreement, or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved exclusively in the state or federal courts located in Jefferson County, Colorado. The parties hereby consent to the exclusive jurisdiction and venue of such courts.
If any provision of this agreement is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
This agreement constitutes the entire understanding between the parties with respect to the subject matter hereof and supersedes all prior agreements, representations, warranties, or understandings, whether written or oral.
No waiver of any provision of this agreement shall be deemed a further or continuing waiver of such provision or any other provision.
